The above applies 81 to the Work as incorporated in a Collective Work, but this does not require the Collective Work apart from the Work itself to be made subject to the terms of this License. 82 If You 83 create a Collective Work, upon notice from any Licensor You must, to the extent practicable, remove from the Collective Work any credit as required by clause 4(c), as 84 requested. You may not distribute, publicly display, publicly perform, or publicly digitally perform the 92 Derivative Work with any technological measures that control access or use of the Work in a manner inconsistent with the terms of this License Agreement. The above applies 93 to the Derivative Work as incorporated in a Collective Work, but this does not 94 require the Collective Work apart from the Derivative Work itself to be made subject to the terms of this License. 95 3. If you distribute, publicly display, publicly perform, or publicly digitally perform the Work or any Derivative Works or Collective Works, You must keep intact all 96 copyright notices for the Work and provide, reasonable to the medium or means You are utilizing: (i) the name of the Original Author (or pseudonym, if applicable) if 97 supplied, and/or (ii) 98 if the Original Author and/or Licensor designate another party or parties (e.g. a sponsor institute, publishing entity, journal) for attribution in Licensor's copyright 99 notice, terms of service or by other reasonable means, the name of such party or parties; the title of the Work if supplied; to the extent reasonably practicable, the 100 Uniform Resource Identifier, if any, that Licensor specifies to be associated with the Work, unless such URI does not refer to the copyright notice or licensing 101 information for the Work; and in the case of a Derivative Work, a credit identifying the use of the Work in the Derivative Work (e.g., "French translation of the Work by 102 Original Author," or "Screenplay based on original Work by Original Author"). Performance Royalties Under Blanket Licenses. Licensor 108 waives the exclusive right to collect, whether individually 109 or via a performance rights society (e.g. ASCAP, BMI, SESAC), 110 royalties for the public performance or public digital 111 performance (e.g. webcast) of the Work. 112 2. Mechanical Rights and Statutory Royalties. Licensor waives 113 the exclusive right to collect, whether individually or via a 114 music rights society or designated agent (e.g. Harry Fox 115 Agency), royalties for any phonorecord You create from the 116 Work ("cover version") and distribute, subject to the 117 compulsory license created by 17 USC Section 115 of the US 118 Copyright Act (or the equivalent in other jurisdictions). 119 6. Webcasting Rights and Statutory Royalties. For the avoidance of 120 doubt, where the Work is a sound recording, Licensor waives the 121 exclusive right to collect, whether individually or via a 122 performance-rights society (e.g. SoundExchange), royalties for the 123 public digital performance (e.g. webcast) of the Work, subject to 124 the compulsory license created by 17 USC Section 114 of the US 125 Copyright Act (or the equivalent in other jurisdictions). 126 127 The above rights may be exercised in all media and formats whether now 128 known or hereafter devised. The above rights include the right to make 129 such modifications as are technically necessary to exercise the rights 130 in other media and formats. All rights not expressly granted by 131 Licensor are hereby reserved. 132 133 4. Restrictions. The license granted in Section 3 above is expressly 134 made subject to and limited by the following restrictions: 135 136 1. You may distribute, publicly display, publicly perform, or 137 publicly digitally perform the Work only under the terms of this 138 License, and You must include a copy of, or the Uniform Resource 139 Identifier for, this License with every copy or phonorecord of the 140 Work You distribute, publicly display, publicly perform, or publicly 141 digitally perform. You may not offer or impose any terms on the Work 142 that alter or restrict the terms of this License or the recipients' 143 exercise of the rights granted hereunder. You may not sublicense the 144 Work. You must keep intact all notices that refer to this License 145 and to the disclaimer of warranties. You may not distribute, 146 publicly display, publicly perform, or publicly digitally perform 147 the Work with any technological measures that control access or use 148 of the Work in a manner inconsistent with the terms of this License 149 Agreement. The above applies to the Work as incorporated in a 150 Collective Work, but this does not require the Collective Work apart 151 from the Work itself to be made subject to the terms of this 152 License. If You create a Collective Work, upon notice from any 153 Licensor You must, to the extent practicable, remove from the 154 Collective Work any credit as required by clause 4(c), as requested. 155 If You create a Derivative Work, upon notice from any Licensor You 156 must, to the extent practicable, remove from the Derivative Work 157 any credit as required by clause 4(c), as requested. 158 2. You may distribute, publicly display, publicly perform, or 159 publicly digitally perform a Derivative Work only under the terms 160 of this License, a later version of this License with the same 161 License Elements as this License, or a Creative Commons iCommons 162 license that contains the same License Elements as this License 163 (e.g. Attribution-ShareAlike 2.5 Japan). You must include a copy of, 164 or the Uniform Resource Identifier for, this License or other 165 license specified in the previous sentence with every copy or 166 phonorecord of each Derivative Work You distribute, publicly 167 display, publicly perform, or publicly digitally perform. You may 168 not offer or impose any terms on the Derivative Works that alter or 169 restrict the terms of this License or the recipients' exercise of 170 the rights granted hereunder, and You must keep intact all notices 171 that refer to this License and to the disclaimer of warranties. 172 You may not distribute, publicly display, publicly perform, or 173 publicly digitally perform the Derivative Work with any 174 technological measures that control access or use of the Work in a 175 manner inconsistent with the terms of this License Agreement. 176 The above applies to the Derivative Work as incorporated in a 177 Collective Work, but this does not require the Collective Work 178 apart from the Derivative Work itself to be made subject to the 179 terms of this License. 180 3. If you distribute, publicly display, publicly perform, or 181 publicly digitally perform the Work or any Derivative Works or 182 Collective Works, You must keep intact all copyright notices for 183 the Work and provide, reasonable to the medium or means You are 184 utilizing: (i) the name of the Original Author (or pseudonym, if 185 applicable) if supplied, and/or (ii) if the Original Author and/or 186 Licensor designate another party or parties (e.g. a sponsor 187 institute, publishing entity, journal) for attribution in Licensor's 188 copyright notice, terms of service or by other reasonable means, the 189 name of such party or parties; the title of the Work if supplied; to 190 the extent reasonably practicable, the Uniform Resource Identifier, 191 if any, that Licensor specifies to be associated with the Work, 192 unless such URI does not refer to the copyright notice or licensing 193 information for the Work; and in the case of a Derivative Work, a 194 credit identifying the use of the Work in the Derivative Work (e.g., 195 "French translation of the Work by Original Author," or "Screenplay 196 based on original Work by Original Author"). Such credit may be 197 implemented in any reasonable manner; provided, however, that in the 198 case of a Derivative Work or Collective Work, at a minimum such 199 credit will appear where any other comparable authorship credit 200 appears and in a manner at least as prominent as such other 201 comparable authorship credit. 105 202 106 203 5. Representations, Warranties and Disclaimer 107 204 108 UNLESS OTHERWISE AGREED TO BY THE PARTIES IN WRITING, LICENSOR OFFERS THE WORK AS-IS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE MATERIALS, 109 EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, OR THE 110 ABSENCE OF LATENT OR OTHER DEFECTS, ACCURACY, OR THE PRESENCE OF ABSENCE OF ERRORS, WHETHER OR NOT DISCOVERABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED 111 WARRANTIES, SO SUCH EXCLUSION MAY NOT APPLY TO YOU. 112 113 6. Limitation on Liability. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, IN NO EVENT WILL LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY SPECIAL, INCIDENTAL, 114 CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF THIS LICENSE OR THE USE OF THE WORK, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 205 UNLESS OTHERWISE AGREED TO BY THE PARTIES IN WRITING, LICENSOR OFFERS 206 THE WORK AS-IS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND 207 CONCERNING THE MATERIALS, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, 208 INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTIBILITY, 209 FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, OR THE ABSENCE OF 210 LATENT OR OTHER DEFECTS, ACCURACY, OR THE PRESENCE OF ABSENCE OF 211 ERRORS, WHETHER OR NOT DISCOVERABLE. SOME JURISDICTIONS DO NOT ALLOW 212 THE EXCLUSION OF IMPLIED WARRANTIES, SO SUCH EXCLUSION MAY NOT APPLY 213 TO YOU. 214 215 6. Limitation on Liability. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE 216 LAW, IN NO EVENT WILL LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR 217 ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES 218 ARISING OUT OF THIS LICENSE OR THE USE OF THE WORK, EVEN IF LICENSOR 219 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 115 220 116 221 7. Termination 117 222 118 1. This License and the rights granted hereunder will terminate automatically upon any breach by You of the terms of this License. Individuals or entities who have 119 received Derivative Works or Collective Works from You under this License, however, will not have their licenses terminated provided such individuals or entities remain in 120 full compliance with those licenses. Sections 1, 2, 5, 6, 7, and 8 will survive any termination of this License. 121 2. Subject to the above terms and conditions, the license granted here is perpetual (for the duration of the applicable copyright in the Work). Notwithstanding the 122 above, Licensor reserves the right to release the Work under different license terms or to stop distributing the Work at any time; provided, however that any such election 123 will not serve to withdraw this License (or any other license that has been, or is required to be, granted under the terms of this License), and this License will continue 124 in full force and effect unless terminated as stated above. 223 1. This License and the rights granted hereunder will terminate 224 automatically upon any breach by You of the terms of this License. 225 Individuals or entities who have received Derivative Works or 226 Collective Works from You under this License, however, will not have 227 their licenses terminated provided such individuals or entities 228 remain in full compliance with those licenses. Sections 1, 2, 5, 6, 229 7, and 8 will survive any termination of this License. 230 2. Subject to the above terms and conditions, the license granted 231 here is perpetual (for the duration of the applicable copyright in 232 the Work). Notwithstanding the above, Licensor reserves the right to 233 release the Work under different license terms or to stop 234 distributing the Work at any time; provided, however that any such 235 election will not serve to withdraw this License (or any other 236 license that has been, or is required to be, granted under the terms 237 of this License), and this License will continue in full force and 238 effect unless terminated as stated above. 125 239 126 240 8. Miscellaneous 127 241 128 1. Each time You distribute or publicly digitally perform the Work or a Collective Work, the Licensor offers to the recipient a license to the Work on the same terms 129 and conditions as the license granted to You under this License. 130 2. Each time You distribute or publicly digitally perform a Derivative Work, Licensor offers to the recipient a license to the original Work on the same terms and 131 conditions as the license granted to You under this License. 132 3. If any provision of this License is invalid or unenforceable under applicable law, it shall not affect the validity or enforceability of the remainder of the terms 133 of this License, and without further action by the parties to this agreement, such provision shall be reformed to the minimum extent necessary to make such provision valid 134 and enforceable. 4. No term or provision of this License shall be deemed waived and no breach consented to unless such waiver or consent shall be in writing and signed 135 by the party to be charged with such waiver or consent. 136 5. This License constitutes the entire agreement between the parties with respect to the Work licensed here. There are no understandings, agreements or representations 137 with respect to the Work not specified here. Licensor shall not be bound by any additional provisions that may appear in any communication from You. This License may not 138 be modified without the mutual written agreement of the Licensor and You. 139 140 Creative Commons is not a party to this License, and makes no warranty whatsoever in connection with the Work. Creative Commons will not be liable to You or any party on 141 any legal theory for any damages whatsoever, including without limitation any general, special, incidental or consequential damages arising in connection to this license. 142 Notwithstanding the foregoing two (2) sentences, if Creative Commons has expressly identified itself as the Licensor hereunder, it shall have all rights and obligations of 143 Licensor. 144 145 Except for the limited purpose of indicating to the public that the Work is licensed under the CCPL, neither party will use the trademark "Creative Commons" or any related 146 trademark or logo of Creative Commons without the prior written consent of Creative Commons. Any permitted use will be in compliance with Creative Commons' then-current 147 trademark usage guidelines, as may be published on its website or otherwise made available upon request from time to time. 148 149 Creative Commons may be contacted at http://creativecommons.org/. 150 242 1. Each time You distribute or publicly digitally perform the Work 243 or a Collective Work, the Licensor offers to the recipient a license 244 to the Work on the same terms and conditions as the license granted 245 to You under this License. 246 2. Each time You distribute or publicly digitally perform a 247 Derivative Work, Licensor offers to the recipient a license to the 248 original Work on the same terms and conditions as the license 249 granted to You under this License. 250 3. If any provision of this License is invalid or unenforceable under 251 applicable law, it shall not affect the validity or enforceability of 252 the remainder of the terms of this License, and without further 253 action by the parties to this agreement, such provision shall be 254 reformed to the minimum extent necessary to make such provision 255 valid and enforceable. 256 4. No term or provision of this License shall be deemed waived and 257 no breach consented to unless such waiver or consent shall be in 258 writing and signed by the party to be charged with such waiver or 259 consent. 260 5. This License constitutes the entire agreement between the parties 261 with respect to the Work licensed here. There are no understandings, 262 agreements or representations with respect to the Work not specified 263 here. Licensor shall not be bound by any additional provisions that 264 may appear in any communication from You. This License may not be 265 modified without the mutual written agreement of the Licensor and 266 You. 267 268 Creative Commons is not a party to this License, and makes no warranty 269 whatsoever in connection with the Work. Creative Commons will not be 270 liable to You or any party on any legal theory for any damages 271 whatsoever, including without limitation any general, special, 272 incidental or consequential damages arising in connection to this 273 license. Notwithstanding the foregoing two (2) sentences, if Creative 274 Commons has expressly identified itself as the Licensor hereunder, 275 it shall have all rights and obligations of Licensor. 276 277 Except for the limited purpose of indicating to the public that the 278 Work is licensed under the CCPL, neither party will use the trademark 279 "Creative Commons" or any related trademark or logo of Creative Commons 280 without the prior written consent of Creative Commons. Any permitted 281 use will be in compliance with Creative Commons' then-current trademark 282 usage guidelines, as may be published on its website or otherwise made 283 available upon request from time to time. 284 285 Creative Commons may be contacted at http://creativecommons.org/ 286 287 The Debian packaging is (C) 2007, Alan Baghumian <alan@technotux.org> and 288 is licensed under the GPL, see above. 289 290 On Debian systems, the complete text of the GNU General 291 Public License can be found in `/usr/share/common-licenses/GPL'. 292 -
